The Hungarian notary public is a civil law notary and as an authority proceeds, like judges, independently and impartially within the judicial branch of power, its procedures are so-called out-of-court procedures.

The notary public and the notary public’s procedure guarantees the clients’ rights in full confidentiality. The objective of the notary public is to enable the observance of the law in all cases falling in his scope of competence without dispute.

One of the main tasks of a notary public is prepare contracts (e.g. loan agreements, inheritance, support, prenuptial, donation, sale and purchase contracts or articles of association etc.) or legal statements, declarations (e.g. will, adoption and debt recognition statements, debt acknowledgement, certificate of incumbency etc.) in notarial deeds. The notary public preserves the original specimens of documents and he releases certified office copies. A notarial deed must not be scrapped and it must not be lost. The continuity of safekeeping is also guaranteed by notary public archives independently from the individual notaries public. A notarised document has a special conclusive force proving the fact that the declaration or statement has been made by the person specified in the document at the place and in the way specified in the public document. The notary public reads out the text of the document so prepared, he explains its content and legal consequences in a way that is easy to understand even for the layman, practically translating it into the language of the man of the street. The procedure to be followed on the basis of a notarised document is enforcement directly without litigation. This means that if either party fails to fulfil its obligation undertaken in the contract, at the other party’s request the notary public attaches an enforcement clause to the document if the relevant statutory conditions are met. Thereby the customers can avoid, in most cases, years of legal proceedings and litigation. Another advantage is the European enforcement title which makes it possible to enforce the notary’s document in regard to undisputed claims or receivables anywhere in the territory of the European Union except Denmark.

The continuous availability of public wills set out in notarised documents or that of private wills deposited with notaries public is ensured by the National Register of Wills and Testaments (Végintézkedések Országos Nyilvántartása).

A notary public not only authenticates signatures and duplicates and notices of dishonour but he also attests other facts of legal importance, with special conclusive force, e.g. he attests general meetings of economic associations, auctions, tendering procedures, drawing lots, the fact that an individual is alive etc. A notary public may issue attestations of data contained in registers of public authenticity, i.e. he may issue authentic certificates of ownership from the land registry or certificates of incorporation from the book of companies.

A notary public is empowered by law to hold documents, money and valuables in safe custody. A notary public is entitled to hold money and valuables in safe custody if in the course of the preparation of the notarised document and in relation to it the notary public is requested by the clients to do so. The notary public always keeps valuable items taken over for safekeeping separately from his own assets.

The notary public provides assistance for the replacement of lost or destroyed securities or deposit books in separate procedures.

Payment orders help quick enforcement of claims for undisputed but unpaid cash debts. Legal persons and businesses can file their claims electronically while private individuals can do so using paper-based documents as well, with any notary public. Cross-border receivables or claims within the European Union can be enforced by way of European payment orders with the aid of the notary public.

Conducting probate actions is part of the notary public’s competence. The purpose of a probate action is to have all issues relating to inheritance without legal dispute and to have all of the necessary legal information provided for those concerned.
Preliminary procedure for providing evidence can be conducted before the notary public, in the framework of which forensic expert may be commissioned.
The notary public keeps the Register of Declarations of Life Partners (Élettársi Nyilatkozatok Nyilvántartása). The register proves the establishment or termination of a Life Partnership.

The Dr. Ádám Tóth’s Notary Public Office has been operating since 1998 in Ferencváros, the 9th district of Budapest, at Ráday u. 34. The notary public office performs the same range of notary public activities as are carried out by all other notary public offices in Hungary. Dr. Ádám Tóth has licences to act in English and German language as well. With the foreign language licence the members of the office are authorised to proceed and to produce documents in the language concerned. The competence of the ‘Dr. Tóth Ádám Notary Public Office’ has competent jurisdiction in probate cases concerning heritages of citizens who were residents of Ferencváros, deceased in March or September; in the case of the production documents or attestations of facts on-site procedures are possible if necessary in the territory of Budapest.

What should I bring with me to the notary?

In case of certification:

  • Company extracts or certificates: identity card (passport) and address card, company registration number or tax number;
  • Specimen of signature or certification of signature with the proving the right of representation: identity card (passport) and address card, company registration number or tax number, in case of social or non-gov organizations, foundations, associations the deed of foundation and the judicial warrant;
  • Certification of signature: identity card (passport) and address card, plus the document you would like to sign before the notary;
  • Certified Copies: identity card (passport) and address card, plus the original document from which you would like to have a certified copy;
  • Extracts from public registers (ie: land registry, company register): identity card (passport) and address card, plus the topographical number of the real property.

In case of a notarial deed:

  • Identity card (passport) and address card, personal identification number and tax card;
  • In case of representation company registration number or tax number;
  • In case of a real property the topographical number;

In case of a probate:

  • Identity card (passport) and address card, personal identification number and tax card;
  • The original bills of the funeral costs;
  • In case there is a motorized vehicle in the heritage the trafic permit (if any).
